Velaphi Delivery – Terms and Conditions

Effective Date: 22 APRIL 2025

Welcome to Velaphi Delivery! By using our mobile application or website, you agree to the following Terms and Conditions. Please read them carefully before placing any orders.


1. Definitions

  • “Velaphi Delivery” refers to our delivery platform (app or website), including its owners, employees, and affiliates.
  • “User” refers to anyone using the Velaphi Delivery platform to place orders or access services.
  • “Vendor” or “Restaurant” refers to third-party businesses listed on the Velaphi platform that provide food or beverages for delivery.
  • “Delivery Partner” refers to the individual assigned to collect and deliver orders to Users.
  • “Order” refers to any request for food or beverages placed via the Velaphi platform.

2. User Eligibility and Account

  • You must be at least 18 years old to use Velaphi Delivery.
  • Users are responsible for maintaining the confidentiality of their account credentials.
  • You agree to provide accurate, current, and complete information when registering or placing an order.

3. Placing Orders

  • When you place an order, you are offering to purchase the food or beverage items from the selected Vendor.
  • Orders can only be canceled within a short window after confirmation. Cancellations after food preparation has started may be charged in full.
  • Velaphi Delivery reserves the right to refuse or cancel any order at its sole discretion (e.g., due to unavailability or location issues).

4. Pricing and Payment

  • Prices listed on the app are set by Vendors and may include applicable taxes.
  • Delivery fees and service fees may be added to the final total during checkout.
  • Payment must be made at the time of order placement using the accepted payment methods.

5. Delivery Process

  • Estimated delivery times are provided for convenience and may vary due to traffic, weather, or other factors.
  • Users must ensure that the delivery address is accurate and accessible. Failure to receive the order due to incorrect address or unavailability may result in cancellation without refund.
  • Our Delivery Partners will attempt to contact you upon arrival. If unsuccessful after [10 minutes], the order may be marked as undeliverable.

6. Vendor Responsibilities

  • Vendors are responsible for the quality, packaging, and preparation of the food and beverage items.
  • Velaphi Delivery does not prepare or package any food and is not liable for food safety or health-related issues.
  • All food-related questions (e.g., allergies, ingredients) should be directed to the Vendor before placing an order.

7. Refunds and Disputes

  • Refund requests will be considered on a case-by-case basis. You may request a refund if:
    • The order was never delivered.
    • The items delivered were incorrect, incomplete, or spoiled.
  • To request a refund, contact our support team within 24 hours of receiving the order.
  • We reserve the right to deny refund requests that are unreasonable or fraudulent.

8. User Conduct

  • You agree not to misuse the app or engage in any behavior that harms Velaphi Delivery, Vendors, or other users.
  • Prohibited actions include but are not limited to: abuse of refund system, use of fake accounts, threatening delivery partners or staff, or violating local laws.

9. Liability and Disclaimer

  • Velaphi Delivery acts only as a facilitator between Users and Vendors. We are not liable for:
    • Food-related issues including health or allergy incidents.
    • Delays or failed deliveries due to incorrect information or factors beyond our control.
  • Our platform and services are provided “as is” without warranties of any kind.

10. Intellectual Property

  • All content, branding, and design elements on the Velaphi platform are owned by us or licensed to us.
  • Users may not copy, reproduce, or distribute any part of the app without written permission.

11. Modifications to Terms

  • Velaphi Delivery may update these Terms and Conditions at any time. Users will be notified of major changes via email or app notification.
  • Continued use of the app after changes implies acceptance of the updated terms.

12. Governing Law

  • These Terms and Conditions are governed by the laws of GAUTENG.
  • Any disputes shall be resolved in the appropriate courts located in PETORIA.
